1. Agreement to Terms

By accessing or using MaktabOS ("Service"), operated by MaktabOS ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you are using the Service on behalf of a school or organization, you represent that you have authority to bind that entity. If you do not agree, do not use the Service.

2. Description of Service

MaktabOS is a school management platform designed for Islamic schools and academies. It provides branded dashboards, attendance tracking, class and teacher management, parent and student portals, billing and invoicing, messaging, and analytics. Each school receives a customized portal (with its own logo, colors, and login) powered by our central system. Access is role-based: administrators, teachers, parents, and students each have appropriate views and permissions.

3. Accounts and Access

You may need an account or access credentials (e.g., email and password, or access code) to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us promptly of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these terms or pose a security risk.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in line with these terms. You must not:

• Use the Service in any way that violates applicable laws or regulations.
• Share access credentials or allow unauthorized persons to use your account.
• Attempt to gain unauthorized access to our systems, other accounts, or third-party data.
• Introduce malware, interfere with the Service, or overload our infrastructure.
• Use the Service to send spam, harass others, or distribute harmful or offensive content.
• Scrape, copy, or resell the Service or data without our written permission.

Schools are responsible for ensuring that their staff, parents, and students use the Service in accordance with these terms and with applicable student-data and privacy laws.

5. Your Data and Privacy

You retain ownership of the data you provide. Our collection, use, and protection of personal data are described in our Privacy Policy. By using the Service, you consent to that processing. You are responsible for having the right to provide any data you submit (e.g., student and parent information) and for complying with applicable data-protection and school-record laws.

6. Payment Terms

Paid plans are billed according to the pricing stated on our website or in your agreement. Fees are typically per student per month or as otherwise specified. You agree to pay all fees when due. Failure to pay may result in suspension or termination of the Service. Refunds are handled according to our then-current policy or as agreed in writing.

7. Intellectual Property

MaktabOS, including its software, design, logos, and content (excluding your data), is owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal school operations during the term of your agreement. You may not copy, modify, or create derivative works of our technology except as permitted in writing.

8. Disclaimers

The Service is provided "as is" and "as available." We do not warrant that the Service will be uninterrupted, error-free, or fit for any particular purpose. We are not responsible for the accuracy of data you or your users enter, or for decisions made based on the Service. Use of the Service is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, we (and our affiliates, directors, employees, and suppliers) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claims related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service if you breach these terms or for other operational or legal reasons. You may stop using the Service at any time. Upon termination, your right to use the Service ceases. We may retain and use your data as described in our Privacy Policy and for backup or legal purposes.

11. Changes to the Service and Terms

We may change the Service or these terms from time to time. We will post updated terms on this page and, for material changes, we may notify you by email or through the platform. Continued use after changes constitutes acceptance. If you do not agree, you must stop using the Service.

12. General

These terms constitute the entire agreement between you and us regarding the Service. If any provision is held invalid, the remaining provisions remain in effect. Our failure to enforce a right does not waive that right. These terms are governed by the laws of the United States (and the state of our principal place of business, if applicable) without regard to conflict-of-law principles.
